DMCA Policy
Hawking Epstein Photo ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Hawking Epstein Photo service that are reported to our Designated Copyright Agent, identified in the sample notice below.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Hawking Epstein Photo service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Hawking Epstein Photo will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Hawking Epstein Photo service.
- Identification of the copyrighted work(s) claimed to have been infringed: Provide specific details, e.g., URL of the original work, title, author, and copyright registration number if applicable.
- Identification of the material that is claimed to be infringing: Provide a description of the material you claim is infringing and sufficient information to permit us to locate the material on the Hawking Epstein Photo service, e.g., the URL(s) of the specific infringing content on our site.
- Your contact information: Provide your mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Please send this notice to our Designated Copyright Agent through our contact page, specifying that it is a DMCA Copyright Infringement Notice.
Filing a DMCA Counter-Notification
If you believe that material you posted on the Hawking Epstein Photo service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written notification to our Designated Copyright Agent (see contact link above). Pursuant to the DMCA, the Counter-Notice must include substantially the following:
- Identification of the material that has been removed or to which access has been disabled: Provide the URLs or other identifying information of the material before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Hawking Epstein Photo may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
